Introduction
Ownership and Protection of Intellectual Property
1.1. Creation of Intellectual Property
a. Any intellectual property created by employees or contractors during their employment or contract with Inkdify shall be considered the property of the company, unless otherwise specified in a separate agreement. b. Employees and contractors are required to promptly disclose any intellectual property created during the course of their work to the designated Intellectual Property (IP) representative or department.
1.2 Protection of Intellectual Property
a. Inkdify is committed to protecting and enforcing its intellectual property rights, including patents, trademarks, copyrights, and trade secrets. Appropriate measures will be taken to safeguard these rights. b. Employees and contractors must respect the intellectual property rights of others and refrain from using third-party intellectual property without proper authorization. c. Properly licensed software, copyrighted materials, and other intellectual property must be used in accordance with the terms and conditions set by the respective owners.
Publicity Rights
2.1 Consent and Release
a. Inkdify recognizes the importance of individuals' publicity rights and acknowledges the need for obtaining appropriate consent before using their names, images, voices, or likenesses in promotional materials or public communications. b. Employees and contractors must obtain written consent from individuals before utilizing their publicity rights in any company-related promotional activities, including advertisements, social media posts, press releases, and marketing materials.
2.2 Privacy Protection
a. Inkdify respects the privacy of individuals and is committed to handling personal information in accordance with applicable privacy laws and regulations. b. Personal information collected for publicity purposes shall only be used for the intended purposes and with the consent of the individuals involved. c. Safeguards will be implemented to protect personal information from unauthorized access, disclosure, alteration, or destruction.
Compliance and Enforcement
a. All employees, contractors, partners, and stakeholders are expected to adhere to this Intellectual Property and Publicity Rights Policy. b. Violations of this policy may result in disciplinary action, up to and including termination of employment or contractual agreements. c. Employees and contractors are encouraged to report any suspected violations of intellectual property or publicity rights to the designated IP representative or department.
Training and Awareness
Inkdify will provide training and awareness programs to educate employees, contractors, partners, and stakeholders about intellectual property rights, publicity rights, and the importance of compliance with this policy. Regular updates and communication regarding IP and publicity rights will be shared to ensure ongoing understanding and adherence to this policy. a. Notice and Takedown Procedure - Reports and Complaints
Introduction
Reporting Intellectual Property Infringement
a. Any individual or entity that believes their intellectual property rights have been infringed upon by content hosted or provided by Inkdify should submit a formal complaint ("Complaint") to our designated intellectual property agent. The Complaint should include the following information: i. Identification of the infringed intellectual property, including copyright, trademark, or patent details;
ii. Sufficient information to locate the infringing material on our platforms or services;
iii. Contact information of the complainant, including name, address, telephone number, and email address;
iv. A statement declaring that the complainant has a good faith belief that the use of the material is unauthorized by the intellectual property owner, its agent, or the law;
v. A statement, under penalty of perjury, that the information provided in the Complaint is accurate and that the complainant is authorized to act on behalf of the intellectual property owner.

iii. Contact information of the complainant, including name, address, telephone number, and email address;

Review and Resolution Process
a. Upon receipt of a valid Complaint, Inkdify will conduct a thorough review of the provided information and take appropriate action in accordance with applicable laws and regulations. b. If the Complaint is deemed valid, Inkdify will promptly investigate the reported infringement and, if necessary, take steps to remove or disable access to the infringing material. c. Inkdify will notify the alleged infringer of the reported infringement and provide them with an opportunity to respond and assert their rights, as permitted by law. d. If the alleged infringer submits a valid counter-notification asserting their rights to the content, Inkdify will provide a copy of the counter-notification to the original complainant and allow a reasonable period for further legal action.
User Privacy Protection
a. Inkdify is committed to safeguarding the privacy and personal information of its users. Any personal information collected during the intellectual property infringement reporting and resolution process will be handled in accordance with our privacy policy and applicable laws. b. Personal information will only be used for the purposes of processing the Complaint and resolving the infringement issue, and will not be disclosed to third parties unless required by law.
Compliance and Cooperation
a. Inkdify expects all users, employees, and stakeholders to comply with this Intellectual Property Infringement Reporting and Resolution Policy and to provide full cooperation during investigations and actions related to reported infringements. b. Any misuse or abuse of this policy may result in appropriate actions, including the termination of user accounts, employee disciplinary measures, or legal remedies.
